Lesson Policy & Terms of Service

This policy explains scheduling, cancellations, memberships, packages, rentals, and safety expectations. If anything is unclear, contact us before purchasing.

Agreement

By purchasing or booking any lesson, package, membership subscription, or rental from Kalman Music Lessons (the “School”), you acknowledge that you have read, understood, and agree to these Lesson Policy & Terms of Service (the “Terms”). These Terms form a binding agreement between you and the School to the extent permitted by law.

The School may update these Terms from time to time. The version posted at /policy is the current version.

Membership subscriptions

Memberships are recurring subscription plans billed automatically until cancelled or paused. Membership lessons are a scheduled entitlement for the billing period and do not roll over. If you do not use a membership lesson within the applicable time window, it is forfeited.

No carry-over

Membership lessons cannot be carried into a future week or billing period. Unused lessons expire automatically. If a student cannot make a scheduled membership lesson, that lesson will not be carried over to the following week.

Weekly / bi-weekly booking rules

  • Weekly memberships: student may book up to one lesson per calendar week.
  • Bi-weekly memberships: student may book up to one lesson every other calendar week.

Pausing

Memberships may be paused at any time with at least 7 days’ notice. Requests must be made in writing (text or email is acceptable). A pause does not restore or carry over forfeited lessons.

Additional charges excluded

Membership pricing covers the lesson(s) included in the plan only. Memberships do not include additional charges that are not part of the lesson itself, such as (without limitation) studio rental fees (if applicable), books, sheet music, instruments, accessories, or other equipment.

Elite complimentary rental

The Elite tier includes one complimentary instrument rental based on availability and limited to: alto saxophone, flute, clarinet, trumpet, and guitar (acoustic or classical). The School may substitute a comparable option or decline if inventory is unavailable.

Cancellations & no-shows

24-hour cancellation window

If a student cancels within 24 hours of the scheduled lesson start time, the lesson is treated as a no-show and is counted as used.

Membership week limits

For membership plans, if a lesson is counted as a no-show or cancelled within 24 hours, a replacement lesson cannot be booked for the same calendar week (weekly plans) or the same applicable two-week window (bi-weekly plans).

Lesson packages

Packages are pre-paid bundles of lessons. Unless otherwise approved in writing by the School:

  • 4-lesson package: unused lessons expire 90 days after purchase.
  • 10-lesson package: unused lessons expire 120 days after purchase.

Important: Package lesson expirations are enforced to maintain teacher availability and scheduling fairness. Exceptions may be granted only at the School’s discretion and must be approved in writing.

Minors & supervision

  • Studio lessons: minor students must be accompanied by a parent or legal guardian.
  • At-home lessons: a parent or legal guardian must be on the premises at all times during the lesson.

Instrument rentals

Deposit and returns

A deposit may be required for rentals. The deposit will be returned in full if the instrument is returned in the same condition as provided, ordinary wear excepted. The School may deduct costs for damage beyond normal use.

Instrument issues

If an instrument develops a fault from normal use, contact us promptly for support. Do not attempt repairs unless approved.

Liability & safety

Participation in music lessons and use of instruments involves inherent risks (including but not limited to minor physical strain). You assume responsibility for your own participation and for the participation of any minor under your care.

  • Kalman Music Lessons is not liable for student injury or loss occurring at home or in studio, to the fullest extent permitted by law.
  • Kalman Music Lessons is not liable for any injuries caused by or related to instruments, to the fullest extent permitted by law.
  • You are responsible for your personal belongings.

Note: Some jurisdictions limit the ability to waive certain liabilities. Nothing in these Terms is intended to disclaim liability that cannot be disclaimed under applicable law.

Refunds & exceptions

No refunds will be given except where required by law or where approved in writing by School administration, in the School’s sole discretion. Any exception does not waive the School’s right to enforce these Terms in the future.

Miscellaneous terms

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
